1. Purpose and Scope

1.1 These Terms and Conditions govern the submission, processing, and resolution of complaints by students and other stakeholders of My Global World University of Applied Science (MUAS).
1.2 Complaints may pertain to administrative matters, assessment processes, learning center services, or other grievances directly related to the operations of MUAS.

2. Eligibility to File Complaints

2.1 Complaints may only be submitted by enrolled students or former students.
2.2 Anonymous complaints will not be accepted unless deemed significant by the Complaints Review Panel.
2.3 Complaints must relate to events, processes, or services occurring within the previous 12 months.

3. Submission Requirements

3.1 All complaints must be submitted using the official MUAS Complaint Form, which is accessible on the institution’s website or available by request from the administrative office. The form ensures that complaints are filed in a structured and consistent format, facilitating an efficient review process.

3.2 The following details are required to complete the submission: The complainant’s full name, as registered with MUAS, if applicable. Accurate and up-to-date contact information, including phone number, email address, and physical address, to enable follow-up communication. A comprehensive description of the issue, including dates, locations, and individuals involved, if applicable. Complaints should be presented clearly and concisely to ensure they are understood by the review panel.

3.3 Complainants must attach relevant supporting materials, such as:

  • Copies of emails, letters, or contracts.
  • Screenshots or photographs related to the issue.
  • Any other documentation that substantiates the claim.
    Failure to include adequate evidence may delay the review process or result in the complaint being deemed incomplete.

3.4 While the above items are mandatory, the Complaint Form may request additional information not explicitly listed here. Complainants are required to complete all sections of the form to the best of their ability. Any omitted or inaccurate information may result in the complaint being returned for resubmission.

3.5 Complaints that are incomplete or fail to meet submission standards will be returned to the complainant with a request for correction and resubmission. MUAS reserves the right to request multiple resubmissions if necessary. It is important to note that not all errors or omissions may be identified during the initial review; additional issues may come to light upon subsequent review, requiring further updates or corrections by the complainant.

3.6 Complaints must be filed as soon as reasonably possible after the issue arises. Filing promptly allows for more effective resolution, as evidence and relevant details remain fresh and accessible. Complaints filed after an extended delay may be reviewed at MUAS’s discretion, considering the circumstances.

3.7 All complaints must be filed in good faith. Submitting frivolous, malicious, or knowingly false complaints is strictly prohibited and may result in disciplinary action or other appropriate measures.

4. Processing and Review

4.1 Upon submission, MUAS will acknowledge receipt of the complaint in writing within five (5) business days. This acknowledgment confirms that the complaint has been received and is under review. Please note that acknowledgment does not imply resolution within this timeframe, as a thorough review process may require additional time.

4.2 All complaints will be assessed by the MUAS Complaints Review Panel, comprising qualified representatives, which may include: Administrative staff familiar with institutional policies. Academic personnel with subject matter expertise. Legal advisors to ensure compliance with applicable standards and regulations.

4.3  The review process is designed to be thorough and impartial. It may include, but is not limited to. Verification: Examining the facts and details provided in the complaint for accuracy and relevance. Clarification: Requesting additional information or documentation from the complainant if necessary. Consultation: Engaging relevant MUAS personnel or external third parties with direct knowledge of the issue for further insights.

5. Resolution and Response

5.1 MUAS aims to resolve complaints within ninety (90) business days of receipt. This timeline begins only once the complaint has been properly submitted. In cases where resubmission is required due to incomplete or improperly filed complaints, the ninety (90) business days will commence from the date of the corrected submission. MUAS cannot begin the review process until all required information and documentation are received. If additional time is required to resolve the complaint due to its complexity or the need for further investigation, the complainant will be notified in writing with an updated timeline.

5.2 Resolutions may include a variety of outcomes based on the nature of the complaint. These may involve corrective actions to address the issue, updates or clarifications to existing policies or procedures, or other remedies deemed appropriate by MUAS. The resolution process is designed to ensure that all complaints are handled fairly, transparently, and in alignment with the institution’s values and standards.

5.3 Once a resolution is reached, the outcome of the complaint will be communicated to the complainant in writing. This communication will include a detailed explanation of the decision made, any corrective actions taken, and the reasoning behind the resolution. If applicable, the response may also outline steps to prevent similar issues in the future. MUAS is committed to maintaining professionalism and clarity throughout the resolution process to ensure the complainant fully understands the outcome.

6. Confidentiality

6.1 MUAS is committed to maintaining the confidentiality of all complaints and associated documentation throughout the complaint resolution process. Confidentiality is a cornerstone of our commitment to ensuring a fair, secure, and respectful environment for all stakeholders involved.

6.2 Information related to a complaint will be shared strictly on a need-to-know basis. This ensures that only individuals directly involved in investigating, reviewing, or resolving the complaint have access to relevant details. These individuals may include members of the Complaints Review Panel, relevant administrative staff, relevant learning centers, and external parties engaged to assist with the resolution, where applicable. The limited sharing of information is intended to protect the privacy of all parties involved while enabling an effective resolution process.

6.3 In cases where a complaint involves allegations of serious misconduct, harassment, discrimination, or any other behavior that may contravene applicable laws or regulations, MUAS reserves the right to disclose relevant information to external authorities or regulatory bodies as required by law. Such disclosures will be made with the utmost care to balance compliance with legal obligations and the privacy of individuals involved.

6.4 MUAS also requires all parties involved in the complaint process, including complainants, respondents, and reviewers, to uphold confidentiality regarding the details of the complaint and any communications related to its resolution. Breaching this confidentiality may result in disciplinary action or other appropriate measures to safeguard the integrity of the process.

6.5 All records and documentation pertaining to complaints will be securely stored and handled in compliance with applicable data protection laws and institutional policies. Records will only be retained for as long as necessary to fulfill the purposes of the complaint resolution process and any legal or regulatory requirements.

6.6 MUAS emphasizes that maintaining confidentiality is essential to fostering trust in the complaint resolution process and ensuring that all parties feel supported and respected throughout the proceedings.

7. Prohibited Conduct

7.1 The following actions are strictly prohibited to ensure the integrity, fairness, and professionalism of the complaint resolution process:

  • Submitting Fraudulent or Malicious Complaints: Filing complaints with knowingly false, exaggerated, or misleading information is strictly forbidden. Such actions undermine the purpose of the process and waste valuable institutional resources. MUAS reserves the right to take action against individuals found to have intentionally submitted false claims.

  • Engaging in Abusive or Threatening Communication: All interactions during the complaint process must remain respectful and professional. Any form of harassment, intimidation, abusive language, or threats directed toward MUAS staff, review panel members, or other individuals involved in the process will not be tolerated and may result in immediate termination of the complaint review.

  • Disclosing Confidential Information Without Authorization: The confidentiality of the complaint process must be respected by all parties. Sharing details about the complaint, the individuals involved, or the resolution process without prior written authorization is strictly prohibited. Such breaches compromise the fairness and integrity of the process and may lead to legal or disciplinary action.

7.2 Consequences of Violations
Violations of these provisions will be addressed promptly and may result in:

  • Dismissal of the Complaint: Complaints filed in violation of these standards may be deemed invalid and excluded from further review.
  • Disciplinary Action: If the complainant is an enrolled student or affiliated individual, violations may result in disciplinary measures, including warnings, suspension, or other penalties in accordance with MUAS policies.
  • Legal Action: In cases of severe breaches, such as malicious complaints or confidentiality violations, MUAS reserves the right to pursue legal remedies to protect its reputation and ensure compliance with institutional and legal standards.

8. Appeals Process

8.1 If the complainant is dissatisfied with the outcome of their complaint, they have the right to submit a written appeal. The appeal must clearly outline the reasons for dissatisfaction, include any additional supporting documentation, and be submitted within ten (10) business days of receiving the original resolution. Appeals submitted beyond this timeframe may not be considered unless exceptional circumstances are demonstrated.

8.2 Appeals will be reviewed by a separate Appeals Panel, which operates independently from the original Complaints Review Panel. This ensures that the appeal is handled impartially and with fresh consideration of the facts. The Appeals Panel may request additional information or documentation from the complainant as part of its review.

8.3 The decision of the Appeals Panel shall be final and binding. Once the appeal process is concluded, no further internal recourse will be available. Complainants are encouraged to ensure that all relevant points and evidence are included in their appeal to facilitate a thorough review.

8.4 MUAS reserves the right to reject appeals that are frivolous, repetitive, or fail to introduce new substantive information that justifies reconsideration of the original resolution.

9. Limitation of Liability

9.1 MUAS shall not be held liable for delays, omissions, or other circumstances beyond its reasonable control that may affect the complaint resolution process. This includes, but is not limited to, delays caused by incomplete submissions, the need for resubmissions, third-party dependencies, or unforeseen disruptions.

9.2 Circumstances categorized as force majeure—including natural disasters, acts of government, pandemics, civil unrest, or other extraordinary events—may further impact the institution’s ability to process complaints within the expected timelines. MUAS will make reasonable efforts to resume normal operations as soon as possible under such conditions.

9.3 This complaints policy does not grant the complainant any rights beyond those explicitly outlined in these Terms and Conditions. MUAS’s liability is strictly limited to the fair and thorough processing of complaints in accordance with institutional procedures.

9.4 MUAS is not responsible for any perceived or actual consequences resulting from the outcome of a complaint, including reputational, financial, or other impacts.

10. Amendments

10.1 MUAS reserves the right to amend these Terms and Conditions at any time without prior notice. Amendments will be published on the official MUAS website, and all complaints filed after the publication of such changes will be subject to the updated terms.

10.2 It is the responsibility of complainants to review the latest version of these Terms and Conditions before filing a complaint. MUAS encourages individuals to check the website regularly for updates.

10.3 Amendments are intended to improve the fairness, clarity, and efficiency of the complaint resolution process. In cases where changes are made during the resolution of a complaint, the process will continue under the terms that were in effect at the time the complaint was originally filed.
